In a rising market like the Costa del Sol, this means many buyers see meaningful equity growth before they even receive their keys. You also get first choice of units, floors, and orientations — the best views and positions go to the buyers who move earliest.
How the Payment Structure Works
Understanding the payment timeline is essential before committing to an off-plan purchase. The typical structure on the Costa del Sol looks like this.
A reservation fee of between €6,000 and €10,000 secures your chosen unit and takes it off the market immediately. This is followed by a private purchase contract typically within 30 days, at which point you pay around 10% of the purchase price minus the reservation fee already paid. During the construction phase staged payments cover a further 20% to 30% of the total price, usually tied to construction milestones every few months. The remaining balance — typically 60% to 70% — is paid at completion when you sign at the notary and receive your keys.
Your lawyer must ensure that bank guarantees protect every staged payment. If the developer fails to complete for any reason your money is returned in full. Never sign a purchase contract without this protection in place.

The Costa del Sol resale market is strong but off-plan new builds offer specific advantages that resales simply cannot match.
New builds come with a 10 year structural guarantee, modern energy efficiency standards, and no immediate renovation costs. The Legal Steps You Cannot Skip

Get your NIE number first. You cannot purchase property in Spain without a Número de Identidad de Extranjero and the process takes time, so start this early. Open a Spanish bank account to simplify fund transfers and ongoing costs. Appoint an independent lawyer who works exclusively for you — not the developer or the agent. Your lawyer will review the developer’s credentials, check the land registry, verify planning permissions, and examine every clause of your purchase contract.
Budget for purchase costs of approximately 12% to 14% on top of the agreed price. For new builds this includes 10% VAT, notary and land registry fees, and your legal costs. On a €400,000 property that means budgeting an additional €48,000 to €56,000.
What to Look for in a Developer
Not all developers are equal and on the Costa del Sol the range of quality is wide. Before committing to any off-plan purchase your lawyer should verify the developer’s track record — how many completed projects they have delivered, whether they have any outstanding legal issues, and whether their bank guarantees are in place and valid.
Established developers with multiple completed projects and strong reputations are significantly lower risk than newer entrants to the market.
